I am up in court soon

Back in march i got into a confrontation outside of a casino.

I was out having a few drinks with a few friends. The two girls we was with got abuse off of some low life because none of them would go home with him. Then he bacame aggressive with other punters untill doorstaff ejected him and his friend. Me and my male friend who also does a lot of training had sat well out of the way to avoid trouble, and got the girls to sit with us and away from trouble.

Later on katy invited me outside for a cig with her, and my male friend followed. We got out side and the two trouble makers were outside. One was pissing in a doorway and the other mouthing off to passes by. we was on top of a set of steps, and they were at the bottom to our left. The main trouble maker became really aggressive and abusive towards katy and i kindly asked him to leave her alone. Then he turned on me. shouted " I'm gona knock him out" and charged up the steps pushing my friend out the way. So i done a pre emp strike, elbowing him strait to the face. When he recoverd from the strike he backed off down the steps and took another good 20 steps away from the bottom of the steps. I went back inside and sat back down and carried on drinking my pint.

Then the police turn up and arrest me for assault. I got bailed twice untill they charged me with GBH unlawfull wounding. The only reason i was arrested and later charged was due to his injury. The strike had brocken his cheekbone and his nose. I have been to court twice and my trial is set for the 26th oct at crown court.

They are trying to say it was excessive force, but my solicitor thinks we have a good chance as it was all caught on camara and i have 3 witneses. and i only struck him once.

I forgot to mention the main point of this post.

In my opinion not enough people stand up for themselves because there to affraid of getting into trouble. In most cases it is either wait till they attack and risk being knocked out and seriously injured. Or pre emp strike and go through months of ploice bails and court cases to prove that you acted in self defence. If he had not recieved such an injury then it would not of even made it to court. What do they expect people to do? only put 50% effort into your strike/strikes just incase you hurt them to much.

Sorry to hear it has been taken this far. Pleased you have witnesses and the cctv to support your case. We all wish you a successful and just, outcome for this issue so you can get back on with your life again mate

I must say you did the right thing,to knock his bones loose rather than yours.That serves him right for mouthing off to passers-by.I had this same situation when i was out with my girl,gave the guy an upper cut while my girl made her Reeboks say hello to his balls :p well atleast he couldnt complain

CCTV footage was quite funny. You see him being aggressive, then charge towards me. Then take off out of camara view. Up untill i saw the footage, i did not realize how hard i had hit him. On his rap sheet he had 8 counts of robbery, battery, theft. He was a known nasty piece of work. After getting nicked, i was in regret of hitting him. After seeing his rap sheet and being cleard i became glad of giving gave him a dig. I had random people messaging me on facebook, saying they want to shake my hand etc and they take there hat off to me

Thats exactly it mate. Its normaly people like us that have the most to loose. The scum bags do not care as there always in trouble anyway. I would like to say that the law will protect you. But its not the case. I very nearly got convicted. I was just lucky enough to have a brilliant solicitor. Who was recommended to me by some bikers, cant mention which MC they were (wish i could as it would make you realize how good the solicitor is) but if any decent person you know is going through the courts then PM me and il give you my solicitors number.

Just ashame that you have to go through such lengths when you CLEARLY acted in self defence. All because you caulsed an injury. If he had no injury, it would not of gone to court. Section 20 GBH is quite a crafty charge. What there basically saying, is that you may not of ment to caulse such an injury, but because of your action he did recieve the injurys. So even claiming self defence may not get you off the hook. Its quite a hard charge to get off with. Just don't break anything and claiming self defence will be much, much, much more simple
